Terms and conditions governing the use of our website and real estate services under Mexican law

1. General Provisions
These Terms and Conditions govern the use of the Riviera Maya Realty website (hereinafter "the Site") and the real estate services offered by the company, located at 5th Avenue, Centro, Playa del Carmen, Quintana Roo, C.P. 77710, Mexico. By accessing or using the Site, you agree to be bound by these terms in accordance with Mexico's Federal Civil Code and Commercial Code.
2. Real Estate Services
Riviera Maya Realty acts as an intermediary in real estate purchase, sale, rental, and advisory transactions in the Riviera Maya, Mexico. Our services include:
- Promotion and marketing of properties.
- Advisory services for purchase, sale, and rental of properties.
- Support throughout the legal and notarial process.
- Property valuation and market analysis.
3. Property Listings
The information published on the Site regarding properties, including prices, features, photographs, and availability, is presented for informational purposes and may be subject to change without prior notice. Riviera Maya Realty makes reasonable efforts to ensure the accuracy of the information but does not guarantee it is error-free. Published prices are indicative and may vary according to market conditions.
4. User Obligations
By using the Site, you agree to:
- Provide truthful and up-to-date information in contact and registration forms.
- Not use the Site for unlawful purposes or purposes contrary to morality and good customs.
- Not reproduce, distribute, or modify the Site's content without prior written authorization.
- Comply with all applicable laws and regulations of Mexico.
5. Real Estate Transactions
All real estate transactions shall be governed by the following provisions:
- Formalization: Real estate purchases must be formalized through a public deed before a notary, in accordance with the Civil Code of the State of Quintana Roo and applicable federal legislation.
- Restricted zone: For foreign buyers of properties located in the restricted zone (50 km from coastlines, 100 km from borders), pursuant to Article 27 of the Political Constitution of the United Mexican States, a bank trust (fideicomiso) will be required.
- Anti-money laundering: In accordance with the Federal Law for the Prevention and Identification of Transactions with Illicitly Obtained Funds, additional documentation may be required to verify the origin of funds in transactions exceeding the thresholds established by law.
- Taxes: The parties shall be responsible for their respective taxes, including Income Tax (ISR), Property Acquisition Tax (ISAI), and public registry fees.
6. Commissions and Fees
Commissions for real estate brokerage services shall be agreed upon in writing between the parties before initiating any transaction. Fees will be calculated as a percentage of the transaction value in accordance with Riviera Maya real estate market practices, plus the applicable Value Added Tax (IVA).
7. Intellectual Property
All content on the Site, including texts, images, logos, designs, databases, and software, is protected by Mexico's Federal Copyright Law and Industrial Property Law. The total or partial reproduction, distribution, or modification of the content is prohibited without the express authorization of Riviera Maya Realty.
8. Limitation of Liability
Riviera Maya Realty shall not be liable for:
- Errors or omissions in the information published on the Site.
- Interruptions in Site service due to force majeure.
- Damages resulting from the use of Site information for investment decisions.
- Content of third-party websites linked from the Site.
9. Consumer Protection
In accordance with the Federal Consumer Protection Law (LFPC), users have the right to clear and truthful information about the services offered. For complaints or claims, you may contact us directly or approach the Federal Consumer Protection Agency (PROFECO) at www.profeco.gob.mx.
10. Jurisdiction and Applicable Law
These Terms and Conditions are governed by the laws of the United Mexican States. For any dispute arising from the use of the Site or real estate services, the parties submit to the jurisdiction of the competent courts of Playa del Carmen, Quintana Roo, Mexico, waiving any other jurisdiction that may correspond to them by reason of present or future domicile.
11. Modifications
Riviera Maya Realty reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon publication on the Site. Continued use of the Site after the publication of changes constitutes acceptance of the modified terms.
